Jennifer Crumbley Shouldn’t Have Been Convicted

Shielding State Secrets makes the Supreme Court the guardian of Leviathan Democracy. A State Secrets claim is the equivalent of a political command to a judge to shut down a case. The State Secrets doctrine presumes that “government knows best, and no one else is entitled to know.” Not only are the feds above the law; they don’t have to explain why they are above the law. Eventually, instead of a good excuse for breaking the law, all that is necessary is to claim that an excuse exists — even if the excuse is secret.
