The Ninth Amendment debunks bad-faith textualism or originalism: “The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people.” (enumeration = specific mention) Read As: ‘If a specific right isn’t directly addressed in the constitution, don’t interpret that to mean the right doesn’t exist.’ When proposing the 9th Amendment, Madison fully admitted that the constitution was, by nature, an imperfect document. This is a point that needs to be highlighted much more.
